GENERAL PROVISIONS

1.1. This Candidate Data Privacy Statement (the “Statement ”) applies to processing of the data from the candidate (“ you” or the “Candidate”) that applies for job vacancies or corporate body duty offerings, including possible internships or contractual opportunities with UAB Seven Seas Europe (“ we” or the “Company”).

1.2. This Statement sets out the basis on which we will process your personal data. This is to ensure the fair and transparent collection and use of your information, as well as protection of your personal data and privacy.

1.3. Definitions used in this Statement:

  • Candidate, you means a person seeking employment or an internship in the Company, seeking to be elected to the corporate body of the Company, or seeking to enter into a contract for the provision of consulting services or any other civil contract with the Company.
  • The Company, we means UAB Seven Seas Europe (company code 304632897, registered office Olimpieciu st. 1-5 LT-09235 Vilnius, the Republic of Lithuania).
  • Data Controller means anyone who alone or jointly with others determines the purposes and means of the Processing of Personal Data. For the Processing of Personal Data described in this Statement, the Company is the Data Controller.
  • Data Processor means anyone who Processes Personal Data on behalf of the Data Controller.
  • Data Protection Legislation means the applicable EU and national data protection legislation that Company is subject to, for example, Regulation (EU) 2016/679 (General Data Protection Regulation or the GDPR).
  • GDPR means Regulation (EU) 2016/679 of the European Parliament, the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
  • Personal Data means any information directly or indirectly related to a Candidate.
  • Processing means any operation or set of operations performed regarding Personal Data (such as collection, recording, storing, erasure, sharing).
  • Recipient means a natural or legal person, public authority or another body, to whom the Company is entitled to disclose Personal Data.
  • Regulatory Legislation means the applicable legal acts that Company is subject to, for example, relating to anti-money laundering, data protection, taxes, bookkeeping, payment services.

I. INFORMATION WE MAY PROCESS WHEN YOU APPLY

2.1. When you apply for a job role at (or otherwise seek to work with), we will process, use and disclose certain information directly from you as well as from third party sources.

2.2. You may give us personal data about you by filling in forms online, corresponding with us by phone, email, in person, or otherwise, or through a recruitment agency or other third party.

2.3. The personal data that we collect about you includes, but is not limited to, the following:

  • your name;
  • home address;
  • contact details (such as telephone number and email address);
  • date of birth;
  • copies of your passport, driving license and similar documents (and personal data included in these documents);
  • education history (including copies of relevant degrees, diplomas or certificates if required), training and professional experience;
  • current and past employment details;
  • immigration status and work permits;
  • languages spoken and level of proficiency; and
  • other information given in your CV.

2.4. During the recruitment process, we do not collect or process any “Sensitive Personal Information” unless except in cases where the Company is required or permitted by law to process such data. Sensitive Personal Information includes but is not limited to the following: information that reveals your racial or ethnic origin, religious, political, or philosophical beliefs, genetic data, biometric data for the purposes of unique identification, or information concerning your health, sex life, or sexual orientation.

2.5. We may collect some or all of the following personal information from other sources when you apply for a role with the Company:

  • References provided by referees.
  • Other background information provided or confirmed by academic institutions and training or certification providers.
  • Information provided by recruiting or executive search agencies.
  • Information collected from publicly available sources, including any social media platforms you use or other information available online.

2.6. We collect and use personal information primarily for recruiting purposes—in particular, to determine your qualifications for employment and to make a hiring decision. This includes assessing your skills, qualifications, and background for a particular role, verifying your information, carrying out reference and/or background checks (where applicable) and generally managing the hiring process and communicating with you about it. The personal data is processed lawfully, fairly, and in a transparent manner in relation to you.

2.7. We obtain and use your personal data under your given explicit consent (i.e., confirming that you “Agree”) or implicit consent (i.e., when you send your CV or other documents necessary for your application for a desired position or you apply via career social networks (e.g., LinkedIn)). If consent is not received, Company will not be able to consider your candidacy for respective position.

2.8. We do not sell your personal data or disclose it to any third parties without your consent.

2.9. We are committed to ensuring that your personal data is safe and take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Statement.

II. DATA RELATING TO CRIMINAL CONVICTIONS AND OFFENSES

3.1. When required and/or allowed by law, we also collect and store personal data relating to criminal convictions and offenses. We only collect such personal data if you have given your explicit consent. This data is only processed where it is necessary for the purposes of:

  • complying with or assisting other persons to comply with a regulatory requirement which involves the Company taking steps to establish whether you have committed an unlawful act or been involved in dishonesty, malpractice or other seriously improper conduct;
  • preventing or detecting unlawful acts (including fraud);
  • any legal proceedings (including prospective legal proceedings);
  • establishing, exercising or defending legal rights.

III. LEGAL BASIS FOR PROCESSING YOUR PERSONAL INFORMATION

4.1. Our legal basis for collecting and using your personal information will depend on the information concerned. However, for the purposes of this Statement, we will process your personal information where: (a) the processing is in our legitimate interests (and not overridden by your data protection interests or fundamental rights and freedoms) and (b) where we have a legal obligation to do so.

IV. FINAL PROVISIONS

5.1. Personal Data will be retained for the period which depends on the particular purpose of Processing for which these data are collected. Retention period is as long as the recruitment process activities (application, evaluation and selection) take place. After the end of the recruitment process, we will retain Personal Data during a maximum period of limitation according to the Regulatory Legislation.

5.2. We respect your control over your information and, upon request, we will confirm whether we hold or are processing information that we have collected from you. According to GDPR, you also have the right including but not limited to amending or updating inaccurate or incomplete personal information, request deletion of your personal information, or request that we no longer use it. Under circumstances we will not be able to fulfill your request, such as if it interferes with our regulatory obligations, affects legal matters or we cannot verify your identity, we will respond to your request within a reasonable timeframe but not later than 1 (one) month from the date of receipt and provide you an explanation.
